Do all employers have to facilitate the program?

No. An employer is required to facilitate the Minnesota Secure Choice Retirement Program only if they meet the following criteria outlined in state statute:

  • They engaged in a business or provides services in Minnesota and reports W-2 taxes in Minnesota for profit or not for profit.
  • That employs 5 or more employees in Minnesota above the age of 18 years old at part or full-time status.
  • That does not sponsor or contribute to a retirement savings plan for its employees and has not in the immediately preceding 12 months.
  • That is not a state or federal government body or agency or any political subdivision thereof.

Note: If your employer does not participate in the program, that it is possible for you (an individual) to set up your own account separately.
