No. An employer is required to facilitate the Minnesota Secure Choice Retirement Program only if they meet the following criteria outlined in state statute:
- They engaged in a business or provides services in Minnesota and reports W-2 taxes in Minnesota for profit or not for profit.
- That employs 5 or more employees in Minnesota above the age of 18 years old at part or full-time status.
- That does not sponsor or contribute to a retirement savings plan for its employees and has not in the immediately preceding 12 months.
- That is not a state or federal government body or agency or any political subdivision thereof.
Note: If your employer does not participate in the program, that it is possible for you (an individual) to set up your own account separately.
